General Terms & Conditions
Please be advised that the regulations and rules contained in this agreement may not be used against "Tarsyah Auctions Company"; rather, they are to be referred to as an agreement that governs the relationship between all parties related to the website. Please note that any ambiguity in one of the regulations or any misunderstanding may not be construed in a manner that adversely affects the interest of any of the parties.
No regulations or rules other than those set out by "Tarsyah Auctions Company" below may be invoked, unless the company's Chief Executive Officer signs a document confirming its commitment to other regulations and rules. Please note that any agreement not signed by the officially authorized party, whether verbal or written, does not bind "Tarsyah Auctions Company" to any legal responsibilities or obligations. "Tarsyah Auctions Company" advises all subscribers and members to read the regulations that govern its relationship with its clients, as clients' continuation of the registration process is deemed acceptance of everything the regulations contain of rules that define the nature of the relationship binding the two parties
All bidders must carry out the periodic updates for Tarsyah Auctions Company's applications and ensure they are using the latest available version of the applications on your device's app store before bidding. Tarsyah Auctions Company is not responsible for the unavailability of any information or for any change in the services resulting from your failure to update the application.
1. Registering a new user on Tarsyah Auctions Company's website entitles the participant to obtain an electronic username and a secret code to use to log in to the electronic auction website, take part in bidding, and edit and raise the offer
2. The participant is aware of the fact that no one other than them is aware of the secret login code, and that they alone bear the responsibility of remembering it and ensuring that others are not enabled to view or use it.
3. In the event of forgetting the secret code or wishing to change it, the participant alone is able to log in to the website to obtain the secret code or an alternative secret code.
4. All transactions are made in Saudi riyals; Tarsyah Auctions Company is not responsible for any loss resulting from currency conversion or the loss resulting from bank transfers between different currencies.
5. The bidder acknowledges that all data provided by them is correct and at their own responsibility and does not contain any error or ambiguity.
6. In the event that the deposit is confiscated from the client for failing to comply with payment, they are placed on the blacklist and are prevented from entering the auction and taking part in auctions, or as determined by the management of Tarsyah Auctions Company.
7. The deposit is refunded according to our registration data; in the event that this amount was paid via another person / another party, the amount is refunded to the source from which the payment was made. All refunds are made via bank transfer.
8. Applying value-added tax on the sale price is one of the obligations of the supplier and not of Tarsyah Auctions Company, in accordance with the system of the Zakat, Tax and Customs Authority.
9. The sale process is subject to the approval of the owner or the sales committee, and the sale procedures may be canceled or extended after or before the end of the auction and before the final sale is completed.
10. Those wishing to take part in the auctions must pay a deposit equivalent to 20% of the value of the required bidding limit in the case of payment by credit card
11. In the event of wishing to pay the deposit by cheques, the value of the cheque must be 100% of the value of the amount you wish to bid with
12. The participant in the auction undertakes to complete the payment process in the event of winning and being awarded the auction; in the event of violating this, the deposit is confiscated and the legal procedures for refusal to pay are taken.
13. Everyone wishing to buy through our website must register their data and choose a username and a password of their own in order to be able to use the website's services.
14. The participant in the auction can raise the bid value on the item offered for sale through the website, taking into account that their bid value is not less than the minimum bid.
15. Any bid made on any item in the last 5 minutes of the auction end time for the item will lead to an increase in the auction time for the item by 5 minutes each time
16. The bidding time is extended in the event of a bid or a technical fault in the last minutes, in order to give the rest of the bidders an opportunity to submit their offers.
17. The right to use all names, trademarks, service names and marks, collectible names, logos, and images belongs solely to the website owners.
18. As a member of the website, you undertake to comply with the instructions set out below when using the website of "Tarsyah Auctions Company" and not to violate any laws, rights, or agreements of any party. Not to use the website if you do not hold the legal authority to bid, or if you are under 18 years of age, or if you have been banned from using the website, whether temporarily or permanently. To complete the payment of the value of the item you purchased. Not to manipulate anything related to the auction such as prices or regulations, and to commit to not circumventing the course of the auctions. Not to publish false, incorrect, or misleading information or information that would defame or tarnish the reputation of any party. Not to give your username with "Tarsyah Auctions Company" to any party, and not to disturb the website's visitors by sending material that would disturb, harm, or spy on any party. Not to send any fabricated messages or material in the name of "Tarsyah Auctions Company"
19. "The Auctions Company" has the right to define, suspend, or terminate any of the services provided by the website, and it also has the right to prevent users from entering the website or remove any material published on it, or to take electronic or legal measures to prevent users from entering the website without prior warning, if the management of "Tarsyah Auctions Company" finds it necessary to take any of the measures set out above for any reason whatsoever. Please note that the company has the right to cancel inactive accounts or non-active accounts when needed.
20. "Tarsyah Auctions Company" has the right to change the fees for the services provided by the website at any time without prior notice, for promotional reasons or when introducing new services.
21. As a user of the website, you undertake not to use
robot, spider, scraper, or other automated means
to access
robot exclusion headers
contained in the website for any reason whatsoever.
22. In addition to the above,
- You undertake not to carry out any activity that would adversely affect the website's infrastructure
-Affecting or attempting to affect the operation of the website or any of its activities

23. This agreement is subject to the laws of the Kingdom of Saudi Arabia, and any disagreement or dispute related to the subject of this agreement is subject to the relevant courts in the Kingdom of Saudi Arabia.
Real-Estate Auction
1. The bidder acknowledges that all data provided by them is correct and at their own responsibility and does not contain any error or ambiguity.
2. The bidder acknowledges that the rules and terms of the auction are announced and communicated to them by Tarsyah Auctions Company, that they have reviewed them and are sufficiently aware of them, and that they have reviewed all the legal terms and penalties related to the course and results of the bidding, and that they accept the actions, procedures, expenses, fees, and commissions due from them as a result of their decision to bid
3. All offers and title-transfer procedures are subject to the approvals of the judicial authorities and the Ministry of Justice; accordingly, Tarsyah Auctions Company is not bound by any announced dates, terms, procedures, or approvals if the reason for their change is due to governmental or judicial orders, procedures, or decisions.
4. The system does not affect usufruct contracts on the property; rental allowances and rental lawsuits are all within the jurisdiction of the Real-Estate Disputes Committee and the competent judicial authorities between lessors and lessees, and everything arising from them or any dispute arising in connection with eviction, recovery of collected rents, and any other matters related to the relationship with the property's users, its facilities, or its beneficiaries must be taken or filed against the previous owner, the lessees, or the beneficiaries; the Real-Estate Authority, the judicial authorities, Tarsyah Auctions Company, its workers, its owners, and those contracting with it have no relation to it, and they are all considered not responsible for any obligation, responsibility, liability, guarantee, or compensation, neither on a criminal, civil, commercial, legal, nor contractual basis.
5. The participant acknowledges that the properties subject to the auction are known to them, that they have inspected them and assessed their value by themselves and at their own responsibility and with their own expertise and sources, and that they did not rely on the assessment of Tarsyah Auctions Company, the advertisements, and their data.
6. The bidder acknowledges that they have the right to take part, that they are not banned or restricted by any law, ruling, or procedure, and that they have the right to hand over the cheque, or the transfer, or top up the wallet as a guarantee of the value of their offer.
7. The participant acknowledges that if their offer is accepted, they will complete the procedures and will immediately deposit the amount due from them within only 10 days of the date of being awarded the auction.
8. The participant exempts Tarsyah Auctions Company from responsibility toward the refusal of the real-estate title-transfer authorities to register the property or transfer its title in their name, or anything that impedes that.
9. The full value is confiscated in cases of the participant violating the auction rules in a way that results in missing the sale opportunity or their failure to complete the deal, without the Real-Estate Authority or the judicial authorities losing their right, and they are fined the difference between the two prices in accordance with the system
10. The bidder undertakes to pay the real-estate transaction tax at a value of 5% of the sale value, in addition to 2.5% of the sale value as a commission in favor of Tarsyah Auctions Company + value-added tax.
11. The bidder bears any banking expenses related to electronic payment operations and is not entitled to claim their refund at any time or under any circumstance.
11. The participant acknowledges that they are aware that the authority competent with respect to recovering the value of rents or vacating the property is the Sharia courts, and that Tarsyah Auctions Company, the Real-Estate Authority, and the judicial authorities bear no responsibility for that; with respect to claims related to the value of the property's rent or its vacating, the competent authority is the judicial authorities, and the buyer to whom the auction is awarded must notify the lessees by means of a notice certified by the notary public that they are the new owner of the property, and the bidder does not have the right to have recourse against Tarsyah Auctions Company.
12. Please note that the company is not entrusted with delivering the property sold in common and undivided ownership, as well as delivering the common shares, and the buyer must follow the necessary legal and statutory procedures in this regard. In the event of there being more than one owner in the ownership of the property, and the sale that took place is of the share of one of the owners, accordingly a single joint ownership will be issued with the rest of the property owners in accordance with the procedures of the judicial authorities in property ownership.
13. Please note that the principle in the sale of the properties offered is that they are sold as-is, and the sale does not include the movable assets inside the property, as well as the name and the commercial license, unless the advertisement states otherwise.
The decisions of the Real-Estate Authority and the Ministry of Justice are applied with regard to accepting or rejecting the submitted offers
Car Auction
1. All items are sold as-is in their location, and Tarsyah Auctions Company does not guarantee any of the acknowledgements, specifications, information, or details provided by the owning party, such as, but not limited to (the accuracy of the odometer reading of the distance traveled – ownership guarantees – the information contained in the attached inspection report if any – the condition of the vehicle or equipment – the year of manufacture – the vehicle's or equipment's conformity to export conditions), and the bidder is responsible for reviewing the data, advertisements, and information related to the condition of the item before entering the bidding
2. All subscribers must inspect the vehicles to be purchased well and ensure the conformity of the offered specifications before bidding on them, as the vehicles are sold in their current condition and the bidder bears full responsibility upon purchase, with no responsibility whatsoever on Tarsyah Auctions Company
3. The sale decision is subject to the approval of the owner, and the sale procedures may be canceled or extended after or before the end of the auction and before the title transfer is completed.
4. Tarsyah Auctions Company does not guarantee the possibility of registering classic vehicles or otherwise.
5. The winner of one of the vehicles offered for sale must pay the value of the vehicle/vehicles via the payment methods available on Tarsyah Auctions Company's website, noting that the payment process must be made within 48 hours of the time of obtaining approval.
6. The full deposit paid will be confiscated if its owner breaches or violates the terms and rules of using the website, or in the event of failure to pay the value of the vehicle or vehicles awarded through the auction
7. Clients can buy and own an unlimited number of the vehicles offered in the auction in accordance with the traffic regulations in force in the Kingdom of Saudi Arabia.
8. "Tarsyah Auctions Company" does not guarantee that the vehicles offered for sale in its auctions conform to the specifications contained in the inspection report, or any other aspects related to the offered vehicles, whether related to their fitness for use, their commercial value, or the condition of the vehicles.
9. The period mentioned for preparing the vehicle's papers is an approximate period, and Tarsyah Auctions Company is not responsible for that period.
10. The winning price of the vehicle does not include expenses such as (title transfer / renewing the registration / licensing / vehicle-transport fees and others .... etc.)
